            The Complaint in this collective action lawsuit, Lenahan, et al. v. Sears Roebuck and Co., was filed in the United States District Court for the District of New Jersey on January 2, 2002, by current and former product repair service technicians employed by Sears.  Plaintiffs allege that Sears' "Home Dispatch Program" results in a widespread failure to pay non-exempt Sears product repair service technicians for the hours that they work in violation of federal and New Jersey State Wage and Hour law.

THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEW JERSEY HAS APPROVED A NATIONAL SETTLEMENT OF THIS CASE  

 

FOR INFORMATION REGARDING THE SETTLEMENT, CLICK HERE

 

THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEW JERSEY APPROVED A NATIONAL SETTLEMENT OF THIS CASE.  AS PREVIOUSLY REPORTED, A GROUP OF TECHS FROM WASHINGTON STATE APPEALED THAT APPROVAL TO THE UNITED STATES COURT OF APPEALS FOR THE THIRD CIRCUIT.  HOWEVER, WE ARE PLEASED TO REPORT THAT ON FEBRUARY 21, 2008, THE COURT OF APPEALS ENTERED ITS JUDGMENT AFFIRMING THE SETTLEMENT.  WE EXPECT PAYMENTS TO BE MAILED BY THE END OF SUMMER 2008.
