Welcome to the Sears Technician Lawsuit
Website. This website, created by the law firms of
Kaplan Fox & Kilsheimer LLP

Schneider & Wallace, provides information
on the collective action lawsuit, Lenahan, et al. v. Sears Roebuck and
Co., Court File No. 02-00045/MLC, filed in the United States
District Court for the District of New Jersey on January 2, 2002, by
current and former product repair service technicians employed by Sears.
This lawsuit specifically challenges Sears' "Home Dispatch Program."
Sears is one
of the country’s leading retailers of apparel, home and automotive products
and services, with annual revenue of more than $40 billion. This
website is designed
to provide potential collective members and other interested parties with
information about the lawsuit and its progress, as well as a means to assist
plaintiffs’ counsel in prosecuting the lawsuit on their behalf.
The
Complaint
alleges Sears' systematic failure to pay its
product repair service technicians for all hours worked under the federal
Fair Labor Standards Act (FLSA). The lawsuit seeks payment of the wages earned, as
well as double damages and other relief, on behalf of the plaintiffs and
potential collective members who join in the lawsuit. All former and
current product repair service technicians who are or will be employed by
Sears during the period
NOVEMBER
15, 2001 to THE PRESENT who have not been compensated for all work performed may be eligible to seek to join in the lawsuit if it is approved as a
collective action.
